We are committed to respecting your privacy. This Privacy Policy applies to the ColorReader Mobile Application and all related websites, applications, services, tools, modules, integrated application sites and remote services, servers, and services residing on servers owned and/or operated by Datacolor, or third parties on behalf of Datacolor (collectively the “Services”).


In connection with providing our Services, there are times when we may ask for or collect information from you, either in the form of anonymous data or personal information. Throughout this Privacy Policy, we use the term “personal information” to describe information that can be associated with a specific person and can be used to identify that person (such as a name, user name, e-mail address, postal address, phone number, credit card details, or account details). This may include device ID, device type, machine ID, geo-location information, computer and connection information, present and former actions taken using sites or accounts linked to the ColorReader account, statistics on page views, traffic to and from our sites, IP address, ad data, standard web log information, and any telephone number you provide us or from which you may call or otherwise contact us.


We may also collect the information you send to us such as correspondence, customer satisfaction surveys or customer service communications, testimonials or user content such as photos, blogs and writings.


Information we collect from other sources:

Your use of our Services may result in you providing us with access to certain personal information, and current and historical usage and transactional data stored by third parties such as, but not limited to vendors, suppliers, plugin providers and social network or media sites (such as Facebook, Google and Twitter) that are integrated into our Services. The data we have access to varies by site and is controlled by your privacy settings on that site and your authorization. By associating an account managed by a third party with your [ColorReader] account and authorizing [ColorReader] to have access to this information, Datacolor may collect, store and use this information in accordance with this Privacy Policy and the Terms of Use.


We may also obtain information from or about you in other ways. For example, we may verify user information with a service provider or combine your information with additional information we collect from other third parties or sources, as authorized and permitted by law.


How We Use Information:

Our primary purpose in collecting personal information is to provide you with a safe, efficient and customized experience. We will collect, use and store your data listed above to:


  • provide, test, or enhance the functionality of the Services ;
  • resolve disputes and troubleshoot problems;
  • prevent, detect and investigate potentially prohibited or illegal activities, and enforce our Terms of Use;
  • customize, measure and improve our Services and advertising;
  • contact you about our Services and those of our corporate family, service updates, targeted marketing and promotional offers based on your communication preferences and where you have agreed to receive these;

How we share information with third parties:

However, for some services information like names, user type, email address and other data might be shared.

Cookies and web beacons:

When you first use our Services Datacolor may send a cookie to your computer that identifies you as a unique user. We may use session cookies (which expire once you close your web browser) and persistent cookies (which stay on your computer until you delete them) to store your preferences, identify you and maintain your signed-in status, and provide you with a more personal and interactive experience. You can set your browser to refuse cookies or delete persistent cookies by following your browser’s help instructions. If you choose to disable cookies, some of our services may not work properly. We may also use web beacons which are typically small graphic objects or pixels that are embedded in a web page. These web beacons allow us or our provider(s) to check that a user has viewed a web page.


Your rights in relation to your personal information:

We may communicate with you at various times, with administrative emails or phone calls, about transactions and service announcements, customer service responses and where we have your consent or are otherwise permitted to send them, promotional emails like special offers, newsletters and updates. You can choose to stop receiving promotional emails at any time simply by using an email unsubscribe function which is detailed at the bottom of each direct marketing email. You may not opt out of receiving administrative messages or customer service responses.


You have certain rights in relation to your personal information. Those rights will not necessarily apply in all cases or to all personal which is processed by us though. You have the right to request that we:


  • provide you with a copy of any personal data which we hold about you;
  • update any of your personal data which is out of date or incorrect;
  • delete any personal data which we hold about you;
  • restrict the way that we process your personal data;
  • consider any valid objections which you have to our use of your personal data; or

International Transfer of Information:

Your personal information will be processed outside of the EEA. For example, we are a data controller based in Switzerland (which has been granted an adequacy decision by the European Commission as ensuring an adequate level of protection of personal data) and we store data on our servers in the United States (and also access it from around the world), and in certain circumstances our third party service providers may store certain personal data in a country outside the EEA.


If we (or our service providers) process personal information outside of the EEA, we will take appropriate measures to ensure that your personal data is adequately protected in a manner which is consistent with this Privacy Policy, and in accordance with applicable laws. Those measures include:


  • in the case of US transfers, entering into European Commission approved standard contractual arrangements (or the Swiss equivalent data transfer agreements), or ensuring the recipient has signed up to the EU-US Privacy Shield (see further; or

We retain information as long as it is necessary and relevant for the purposes for which we use it (as set out in the ‘How We Use Information’ section above).

We treat data as an asset that must be protected and use tools (encryption, passwords, physical security, etc.) to protect your personal information against unauthorized access and disclosure. However, as you probably know, third parties may unlawfully intercept or access transmissions or private communications, and other users may abuse or misuse your personal information that they collect from the site. Therefore, although we work very hard to protect your privacy, we do not promise, and you should not expect, that your personal information or private communications will always remain private.

Datacolor does not control the privacy policies of third parties, and you are subject to the privacy policies of those third parties where applicable. If we decide to change our privacy policy, we will post those changes on the Services and notify you of material changes with an alert on the Services or an email communication to you. Changes take effect 30 days after they are posted to the Services. This policy was last updated effective November 14, 2017.
